In NY can he get unemployment if he’s fired?
My boyfriend current works at a popular closeout store part time in New York. His manager doesn’t like him, She’s very judgmental and recently cut his hours big time to 6 a week. They are now trying to say he’s stealing things because they found toy packages in the back.
We do have a 10 month old daughter but i assure you she has no extra toys we’re struggling and she’s very limited at what she does have to play with. The toy in question was a batman toy for ages 10+.
Clearly they are trying to get him to quit but he won’t because we need the money even if at this point it isn’t much. He’s a hard worker and even his co-workers point that out.
My question is if they do end up firing him to get rid of him will he be able to get unemployment while he is looking for another job?
He works one day a week and the items coming up missing are happening when he’s not even there.
Not if they say they fired him for stealing or violating company policy. However he can file unemployment if his hours were cut to the extent he can no longer make a living. The unemployment will pay for a portion of the hours he is now missing and he can continue to work the same job with the hours given. This will probably cause them to either give his hours back or fire him for the stealing though. Sounds like they will be doing that anyways so try to get a few checks out of those SOB’s.
